Globalcare Network, Inc. & Globalcare International LLC Terms of Service

Welcome, and thank you for your interest in Globalcare Network, Inc. and Globalcare International LLC (“Globalcare,” “we,” or “us”) and our website at www.getglobalcare.com, along with our related websites, mobile applications, and other services provided by us (collectively, the “Service”). These Terms of Service are a legally binding contract between you (“you” or “User”) and Globalcare regarding your use of the Service.
PLEASE READ THE FOLLOWING TERMS CAREFULLY:
BY ACCESSING OR USING THE SERVICE, YOU AGREE THAT YOU HAVE READ AND UNDERSTOOD, AND, AS A CONDITION TO YOUR USE OF THE SERVICE, YOU AGREE TO BE BOUND BY, THE FOLLOWING TERMS AND CONDITIONS, INCLUDING GLOBALCARE’S PRIVACY POLICY (TOGETHER, THESE “TERMS”). IF YOU ARE NOT ELIGIBLE, OR DO NOT AGREE TO THE TERMS, THEN YOU DO NOT HAVE OUR PERMISSION TO USE THE SERVICE. YOUR USE OF THE SERVICE, AND GLOBALCARE’S PROVISION OF THE SERVICE TO YOU, CONSTITUTES AN AGREEMENT BY GLOBALCARE AND BY YOU TO BE BOUND BY THESE TERMS.
YOU AGREE TO RECEIVE TEXTS/CALLS FROM OR ON BEHALF OF GLOBALCARE AT THE PHONE NUMBER YOU PROVIDE TO US. THESE TEXTS/CALLS WILL INCLUDE REMINDERS AND UPDATES CONCERNING YOUR APPOINTMENTS. YOU UNDERSTAND AND AGREE THAT THESE TEXTS/CALLS MAY BE CONSIDERED TELEMARKETING UNDER APPLICABLE LAW, THEY MAY BE SENT USING AN AUTOMATIC TELEPHONE DIALING SYSTEM OR OTHER AUTOMATED TECHNOLOGY, AND YOUR CONSENT IS NOT A CONDITION OF ANY PURCHASE.
ARBITRATION NOTICE. Except for certain kinds of disputes described in Section 18, you agree that disputes arising under these Terms will be resolved by binding, individual arbitration, and BY ACCEPTING THESE TERMS, YOU AND GLOBALCARE ARE EACH WAIVING THE RIGHT TO A TRIAL BY JURY OR TO PARTICIPATE IN ANY CLASS ACTION OR REPRESENTATIVE PROCEEDING.
1. Globalcare Service Overview
The Service provides a platform where users can access a network of independent foreign doctors and clinics outside of the U.S. that have undergone a vetting process and who agree to offer certain healthcare services to eligible patients who travel to their clinics (“Provider(s)”). The Service also helps users manage their interactions with Providers, including by booking appointments; providing a technology platform for Providers to communicate with their patients; and other features made available through the platform from time to time.
2. No Recommendations or Medical Advice
Globalcare is not a referral service and does not recommend or endorse any particular Provider. Rather, Globalcare is only an intermediary that provides selected information about Providers. You assume all responsibility in connection with choosing any Provider. No information on this Service should be construed as medical advice. You should consult a qualified healthcare professional for any medical concerns.
3. Medical Information
You may elect to supply certain medical information for the Service, including by requesting an appointment or submitting medical history information. You authorize Globalcare to provide this information to your chosen Provider. You acknowledge that such information will be reviewed and approved by you for accuracy and that Globalcare may use it in accordance with our Privacy Policy.
4. Eligibility & Account Registration
You must be at least 18 years old to use the Service. By agreeing to these Terms, you represent and warrant: (a) you are at least 18 years old; (b) you have not previously been suspended or removed; and (c) your use complies with applicable laws. If you are an entity, the individual accepting these Terms on your behalf has authority to bind you.
Account Registration. You may register for an account using:
- Email and password;
- Google account; or
- Facebook account.
You agree to provide accurate, current, and complete information and to keep it updated.
5. Licenses
5.1 Limited License. Subject to your compliance, we grant you a limited, non-exclusive, non-transferable license to use the Service for personal, non-commercial purposes.
5.2 License Restrictions. You may not reproduce, distribute, publicly display, create derivative works, modify, reverse-engineer, or circumvent any security features of the Service.
5.3 Feedback. If you provide Feedback—ideas or suggestions regarding the Service—you grant Globalcare an unrestricted, perpetual, irrevocable, royalty-free license to use, modify, and incorporate that Feedback into the Service without obligation to you.
6. In-App Features
Through the Service, you can:
- Browse detailed Provider profiles and reviews;
- Exchange secure messages and medical documents with Providers;
- Book, confirm, reschedule, or cancel appointments;
- Coming Soon: Book travel and pay for services and concierge add-ons entirely in-app.
7. Provider Payment Terms
Globalcare provides high-level estimates for procedures. If you request quotes, we forward your information to Providers. You authorize Globalcare (or its processor) to place holds and capture final charges on your payment method and to remit payments to Providers. All payments are non-refundable unless stated otherwise.
8. Credit and Debit Card Processing
Upon selecting a Provider, your bank may place a hold on your card for up to five business days. You authorize us to place and capture such holds to guarantee charges.
9. Cancellation
Bookings canceled fewer than fifteen (15) calendar days before the appointment may incur a $99 USD cancellation fee. You are responsible for timely cancellation.
10. Ownership; Proprietary Rights
All materials on the Service—code, text, graphics, logos, and data—are owned by Globalcare or licensors and protected by IP laws. You may not use these materials beyond the rights granted herein.
11. Third-Party Terms
11.1 Third-Party Services & Linked Websites. The Service may integrate with third-party providers (e.g., payment processors, travel platforms). By using such tools, you authorize transfer of your data. We are not responsible for third-party actions, content, or privacy practices; please review their terms.
12. Communications
12.1 Text & Calls. You consent to receive automated and manual calls/SMS at the number you provide for reminders, updates, and marketing. Standard rates apply. Reply “STOP” to opt out of marketing; “STOPALL” to opt out of all communications (which may limit Service functionality).
12.2 Email. We may send promotional and operational emails. You may unsubscribe from promotional emails via the link provided.
13. Prohibited Conduct
You agree not to:
- Violate any law or third-party rights;
- Harass, threaten, demean, bully, or harm any person;
- Provide false/misleading information or engage in mystery shopper activities;
- Use the Service for commercial solicitation unrelated to booking or treatment coordination;
- Spam or harass Globalcare staff or Providers;
- Conduct unauthorized market research or surveys;
- Scrape, harvest, or collect proprietary/non-public data;
- Upload malicious code or disrupt Service operations;
- Impersonate others or claim false affiliation;
- Sell or transfer access or materials under these Terms.
14. Modification of Terms
We may update these Terms at any time. Material changes take effect 30 days after posting. Continued use constitutes acceptance. Except as provided, amendments require written agreement.
15. Term, Termination, and Modification of the Service
15.1 Term: Effective upon your acceptance or use, and continues until terminated.
15.2 Termination: Violations terminate your rights immediately. We may suspend or terminate access at any time. You may terminate by emailing support@getglobalcare.com.
15.3 Effect of Termination: Sections 1, 2, 5.3, 6, 7, 9, 13, 16–19 survive termination.
16. Indemnity
You agree to defend and indemnify Globalcare and its affiliates from claims arising out of your use, breach of these Terms, or infringement of any rights.
17. Disclaimers; No Warranties
The Service is provided “AS IS” and “AS AVAILABLE,” without warranties. We disclaim all express and implied warranties, including merchantability and fitness for a particular purpose.
18. Dispute Resolution and Arbitration
18.1 Agreement to Arbitrate: Except as in 18.2, disputes will be resolved by binding arbitration under the Federal Arbitration Act and AAA Consumer Rules.
18.2 Exceptions: Small claims court, administrative remedies, injunctive relief, and IP infringement claims are excluded.
18.3 Opt-Out: To opt out, send written notice within 30 days of first accepting these Terms to:

18.4 Arbitrator: Administered by AAA under its Consumer Arbitration Rules (www.adr.org; +1-800-778-7879).
18.5 Commencing Arbitration: Send Notice of Arbitration by certified mail/FedEx (signature required) or email if no address. Notice must identify claimant, dispute basis, and relief sought. Attempt good faith resolution within 30 days, then commence arbitration. Globalcare will reimburse filing fees unless claim exceeds US$10,000 or there have been 25 similar demands. Frivolous claims fee allocation per AAA Rules.
18.6 Proceedings: Venue at claimant’s residence; methods: documents-only, telephonic/video, or in-person per AAA Rules. Arbitrator issues written decision.
18.7 Relief. The arbitrator may award any relief that would be available if the claims had been brought in a court of competent jurisdiction. If the arbitrator awards you more than your actual out-of-pocket damages, Globalcare’s liability for any bonus payment is capped at US$5,000.
18.8 No Class Actions: No Class Actions: No Class Actions: Claims must be individual; no class, collective, or representative actions; no consolidation.
18.9 Modifications: Substantive changes to arbitration may be rejected within 30 days; prior provisions survive.
18.10 Enforceability: If 18.8 or entire Section 18 is unenforceable or you opt out, then Section 19.2 (Governing Law) applies.
19. Miscellaneous
19.1 General Terms: Entire agreement; assignment; waivers; severability.
19.2 Governing Law: Texas law; venue in Dallas County, TX courts if arbitration unenforceable.
19.3 Privacy Policy: Incorporated by reference.
19.4 Additional Terms: Policies posted or linked are incorporated.
19.5 Consent to Electronic Communications: You consent to electronic notices per our Privacy Policy; electronic communications satisfy writing requirements.
